TRAI announces a new regulation for DTH

Sep 01: The Telecom Regulatory Authority of India, TRAI has announced to issue a new regulation for Direct to Home Broadcasting Services to prevent the interest of DTH subscribers and their welfare. The DTH Operator now cannot disable the set-top boxes of the subscribers who want to discontinue the DTH service. This regulatory will be known as ‘Quality of Service and Redressal of Grievances Regulation, 2007’ that will be implemented from Dec 01, 2007.

TRAI announced on Friday to protect the DTH subscribers’ welfare against the cable operators that charges their clients on the behalf of several schemes and plans without giving them prior information. This new regulation will also prohibit changing the running scheme frequently. The operators will have to continue the scheme for at least six-month periods and also have to inform their customers well before making changes.

The DTH operator cannot force the customer to choose the package against their wish; Operators will have to provide the packages what customers want. TRAI has made clear that subscribers are free to discontinue the service and the operators will have to refunds money for DTH equipment that they ask at the timing of installation on security basis and the cost of equipment.

The operators will have to allow the users to choose the DTH equipments on the rent basis instead of only lump-sump charges as well as they can not force the new subscribers to repurchase the DTH equipment if the customers already have it no matters of which company. Usually the subscribers have to pay between Rs 3,000 and Rs 4,000 for the DTH hardware pack Besides this the customers will have full authority to move on to rival service providers if they provide better services at lower costs.

At present DD Direct+, Dish TV and Tata Sky are the DTH service providers currently operating their services across India while SUN TV, Reliance Blue Magic and Bharti Telemedia are expecting to launch their DTH operations in the coming months.

Despite of DTH subscribing the customers will have the option to use the device to access “Free to Air” channels. TRAI has also strictly instructed to the DTH operators establish toll free call centers with sufficient capacity to handle the load of the calls from their customers and to solve all the problems of the clients within five days of complaining and all billing complaints within seven days.

This new regulation will be quite beneficial for the customers but for the operators, it is not as pleasant as they cannot do willingly what they want. "This is a welcome move for the industry, and we have been following a number of these provisions. But we wanted TRAI to also look at incentivising us financially by advocating the removal of value added tax, which it has ignored”, said a senior Dish TV official on the condition of not to reveal the name.

Meanwhile, this new regulation will be very beneficial for the general customers and the numbers of DTH subscribers will be enhance due to this new regulation as they feel more freedom to opt for a particular service provider and have no limitation to lock longer to a company in the condition of not getting satisfaction.

I have taken DTH connection from Air Tel, At the time of taking connection one particular channel we have requested for that purpose only we have taken connection. After taking connection they have discontinued that channel, when I informed the same to customer care, they are informed that that particular channel (i.e, Bhakti channel) is no more available with them. Can I get back my amount what I have paid inetianelly ?

I obtained a DTH connection from a famous provider last year for a particular fee and now they are from time to time discontinue certain important channels originally promised and provided at the time of giving the connection and included in separate add-on packages. I initally obtained the connection only because they offered these packages. In fact, we dont usually see many of the channels provided by the provider. Does a subscriber have a right to select channels of his choice or is there any regulation by TRAI on this. When I contacted the Customer Care of the provider, they informed that if we terminate the connection, then I cannot use the equipment for receiving signals through some other provider.

Can anyone provide some advise on this.

All rules and regulations laied by TRAI are in DHT operators pockets. Nothing but nothing comes true for single customer who pay around Rs.3,000 to Rs.4,000/- and finds, just only pay and get RAM BHAROSE services from DTH operators spcially from TATA SKY. Their systems wiil be under upgradation or customers will be asked to call after half an hour. There is NO toll free numbers. Customers just have to pay for lodging complaints or speaks to Customer care officers. They WILL put you on hold for ten to fifteen minutes. (Payments from
Customers Pockets for calls to attain) No massages or E mails will be sent to customers accounts even after customers pay yearly subscriptions. Tata are not making any profits? OR they are under financial crunch. If this mails reaches to Tata Sky management I challange you your Tata Sky will be thrown in sky even people have paid you. I suggest you must start some charity for you and your organisation. AND IF this mail is read by Mr. Ratan Tata OR SOME STUPID SKY Management please do not cheat you people start charity for your staff or your agencies.

Best way which is favouable both to DTH provider and the customer is to make the DTH equipment available in the market as one buys a TV set or a Mobile set and customer should approach the DTH provider of his choice for connection as in mobile system.

TataSky has started fleecing current customers by removing BBC and certain Sports channels which were in the basic package and creating two new bouquets. The charges for these bouquets surpass the reduction given for removing these channels from the basic package by a factor of 4 to 5.
Why cannnot the CAS be made mandatory for DTH Operaots also, since they already have Desk-top boxes at customer sites and can activate the channels required by the customers? This will stop the kind of exploitation started by TataSky.

Competition will certainly bring down cable subscruber.Policy reformation must be implemented with crystal clarity with the kind of digitisation hence cable operators need to optimise their network to stand in line with rivals.
TRAI also should take well defined measures for radiation hazards too.Proper RF compliance should be met as per Industry standard.Satellite technology is rapidly growing revolutionary changes, transponder capacity will increase band width and subside only cost of implementation but also soothing price to the consumer.
TRAI is very very slow on some of measures.I hope it understands the consumer interest well.

i have execpted for comming back on dd direct in sun tv and jaya .... what the reason for removed sun tv , sun news and jaya channels..... when the other new tamil channels are tune in dd direct....???? reply

I was hapy reading the news but the effect of trai's directive has not shown so far, it seems trai is sleeping. TRAI should use its stick to bring DTH operators in order.

DD DTH is out of tune with customer needs & should be scrapped instantly.It simply thinks in 14th century fashion. Allow more private players but witha cap on monthly charges to be decided by TRAI.

DD DTH should increase its channel rather is has been reducing it ETC punjabi and Zsmile are no more there , i think private DTH operator never want that DD DTH survive ,some conspiracy is going on

This is absolutely a great news. Thanks to TRAI. One had to stick to the same DTH provider becuase he could not use the same equipment for another provider or he had to invest a huge amount again. Now that issue addresses with this new regulation. I have one more request to TRAI. Please ask even the 'so called' DD Direct Plus to either increase the channels, as promised (by the minister) to the customers in the beginnings to attract customers or to arrange for a refund for the equipment bought by the customers. Instead of increasing channels, the number of channels are dicreasing day by day. I think TRAI should intervene on this matter.
