US frame charges on six suspects of 9/11 WTC case

New Delhi, Tue, 12 Feb 2008 NI Wire

The US defence head quarter Pentagon has framed a list of 169 charges over six Guantanamo Bay prisoners for their alleged involvement in the September 11, 2001 twin tower attacks in which nearby 3,000 had died.

The prosecutors of Pentagon will look for death penalty of all the suspects including the alleged mastermind of the conspiracy Khalid Sheikh Mohammed, whose trial is likely to begin in the controversial military tribunal system. However, the prosecutors have appealed to begin the trail jointly in the military tribunal court under the Military Commission Act, 2006 set up by US Congress.

Pentagon has taken more than a six years term for beginning the hearing process, while the dependents of victims, whose relatives had died on 9/11 World Trade Tower accident has appeal to Pentagon to complete the hearing process as soon as possible. They are also seeking death penalty for all the six captives.

Some of the law experts still believe that the hearing trial might not be ‘completely fair’ as the key suspects of the plot Khalid Sheikh Mohammed was looking martyr and CIA has first time accepted that water-boarding technique had been used over Khalid to get accepted the crime.

Water-boarding is a torture technique in which the victim is drawn till he/she reaches at the edge of death. This confession of Khalid might be tricky for him, as human rights group believes that ‘it is the violation of human rights’.

On the other hand, Brigadier General Thomas Hartmann, a legal adviser to the head of the Pentagon's Office of Military Commissions, said that there would be no secret trial and the hearing of this case would be as open as other cases. “Relatively little amounts of evidence will be classified” he said.

However, he has also mentioned that the accused would get the both the military and civilian defense lawyers to defend them. They can also appeal against the judgment in the upper court.

Besides, Khalid the other captives are Walid Bin Attash, Ramzi Binalshibh, Ali Abd al-Aziz Ali, Mustafa Ahmad al-Hawsawi, Mohammed al-Qahtani.

Khalid Sheikh belongs to Kuwait but was arrested from Pakistan, while Ramzi Binalshibh and Walid Bin Attash are from Yemen, Abd al-Aziz Ali are a Pak citizen but detained from Kuwait. Mustufa Ahmad and Mohammed al-Qahatani are Saudi Arabic citizens, as pentagon officials reported.

The framed Charges

The US military officials have framed a long-listed charges over the defendants including conspiracy, murder in violation of the law of war, attacking civilians, attacking civilian objects, intentionally causing serious bodily injury, destruction of property in violation of the law of war, terrorism and providing material support for terrorism.

The above charges were imposed on all the six defendants while the charges of hijacking and destructing the plane were framed only four accused comprises Ramzi Binalshibh, Walid Bin Attash, Ali Abd al-Aziz Ali and Khalid Sheikh Mohammed.

The Military Commissions Act, 2006 has been set up for non-US citizens especially suspected militants.

In September 11, nineteen men hijacked four planes in US in which two planes hit the World Trade Center in New York, another tried to hit the Pentagon in Washington but destroyed before the reaching and the fourth crashed in the way in Pennsylvania, as per US army report cited.
