The Central Bureau of Investigation (CBI) today opposed the petition of dentist couple Rajesh and Nupur Talwar for transferring the trial of the case from Ghaziabad district court to Delhi local court.
The Talwar couple has filled a plea in Supreme Court seeking the permission to conduct the trial in a local Delhi Court transferring from Ghaziabad Court.
The Talwar Couple is the prime accused in famous double mystery murder of a 14-old teenage girl, Arushi Talwar, who was her daughter, and a 15-year old Nepali domestic servant Hemraj.
The trial of this twin murder case is pending in the Ghaziabad district court and the couple reportedly want to transfer it into a local Delhi Court, which was opposed by federal investigating agency.
Additional Solicitor General Haren Raval, appearing for the agency, today argued that there might be "some hidden motives" behind filing of the plea. He pointed out that the petition for transfer of the case might have been filed as section 438 of the Criminal Procedure Code (relating to anticipatory bail), which is not applicable in Uttar Pradesh.
After hearing the argument, a bench headed by Justice B S Chauhan asked him to file the response of the CBI by Thursday and listed the matter for further hearing on February 27.
Earlier, on February 3, the court had sought the CBI's response on the plea of the Talwar couple for transferring the trial relating to the murders of their daughter Aarushi and domestic help Hemraj from Ghaziabad to Delhi.
The apex court had given the agency four weeks to file their reply, after the couple had claimed that most of the witnesses were Delhi-based and that the atmosphere in the Ghaziabad court was hostile since Rajesh Talwar was the victims of a knife attack in January last year.
