Allahabad, Sept 27 (ANI): The Chief Judicial Magistrate of Gorakhpur has been directed by the Allahabad High Court to pass an order for another FIR against Bharatiya Janata Party (BJP) MP Yogi Adityanath and his supporters for allegedly inciting a mob to loot and set afire shops belonging to minority community.
Justice V K Verma passed the order on a revision petition filed by Pervez Parwaz of Gorakhpur, who had challenged the Chief Judicial Magistrate's (CJM) order dated July 29, 2008, whereby his application for filing an FIR against Adityanath and his supporters were rejected.
The CJM in his July 29 order had said that an FIR had already been filed at Gorakhpur's Cantt Police Station in connection with the alleged incident of loot and arson by Hazarat that took place on January 2007, and that there was no reason to file a second FIR in this connection.he High Court, however, observed that filing of a separate FIR by a different complainant was valid.
It also held that the CJM's order was "wholly illegal" and "liable to be set aside".
The High Court directed the CJM to issue a fresh order and ordered proper investigation to be conducted. (ANI)
