The Mumbai Police on Wednesday finally filled a 73-page charge sheet against Maharastra Nav Nirman Sena (MNS) Chief Raj Thackeray and 19 other activists of his party accusing them for rioting and assaulting the North-Indians during the Railway Recruitment Board examinations at Chetana College, Bandra, in October 2008.
The statements quoting 32 witnesses including 14 Maharashtriyan comprises – supervisors, college staff, police officers and students – have been filled in a local Magistrate court on November 18, 2009 in Mumbai in the presence of the accused including Raj Thackeray.
According to statement of witness registered in the charge sheet, Raj Thackeray was inciting the mob while the activists were ‘abusing and beating the candidates,’ citing the slogans of ‘MNS Jindabad,’ ‘Raj Thackeray Jindabad,’ ‘Jai Maharastra,’ and tearing the questions and answer sheets.
The police have booked the accused under sections the Indian Penal Code (IPC) sections, 141, 142, 143, 145, 146, 147, 149 for unlawful assembly and rioting; some more serious sections include 152 (assaulting or obstructing public servant when suppressing riot), 153 (for provocation with intent to cause riot), 153 (a) (promoting enmity between groups), 153 (b) (imputations, assertions prejudicial to national-integration), 336 (endangering life), 341 (punishment for wrongful restraint), 352 and 353 for assault or criminal force, 425 and 426 for causing mischief, 506 (punishment for criminal intimidation), and provisions of the Criminal Amendment Act 7.
A copy of charge sheet has been distributed among each accused and the court has declared the next hearing date on September 13, 2010. Thackeray was looking calm and cool before the court at the time of submitting the charge sheet.
The charge sheet describes the incident that happened in October 2008 when Raj Thackeray with MNS activists had barged into Chetna College premise with raising slogans, tearing posters and abusing North Indians and alleged railways to not to inform about the Railway Recruitment Examination to the ‘locals’ and advertisement were published only in the North-Indian newspapers.
The mob then beat the examinees in which most of them were from Bihar and Uttar Pradesh while some Maharastrian candidates could not escape themselves from that violence.
The Police then arrested Raj Thackeray on October 21, 2008 taking action against the complaints filled by the victims. Raj was released on bail on the same day.
